Once you have received your decision
The Home Office will notify you of the outcome of your asylum claim via letter, either to yourself or to your named legal representative. Depending on whether your claim is positive or negative, there are different processes to follow.
Contents
Positive decision
If you have received a positive asylum decision, you will be granted refugee status or humanitarian protection. Once the Home Office have served your decision, this will trigger a notice to your accommodation provider. You should have 28 days notice from when the Home Office served the decision, but you may not always get 28 days from your accommodation provider.
During this time, there are certain things you will need to do. Please see our find help with housing page, where you can find the contacts for your local housing options team and further guidance on what to do once you’ve received a positive decision.
Negative decision
If you receive a negative asylum decision, then you will need to speak to your lawyer as soon as possible. You may be able to appeal your decision. You can find out more about Home Office Asylum Decision (grant of status/refusal) ( Right to Remain.org.uk) and how to appeal on the right to remain toolkit. There is a nationwide shortage of legal aid lawyers.
If you submit your appeal, then you could still be eligible for Section 95 support. You will need to notify Migrant Help of your appeal to prevent your support from being ended.
If you do not appeal your negative asylum decision, then you will be given 21 days’ notice from when that decision is served to leave your asylum accommodation. The financial support you may be provided with will also stop.
You may be able to apply for section 4 support, in some cases. If you wish to apply for section 4 support, you will need to speak with Migrant Help.
